These terms apply to an organization (the organizer, you) that engages Stringbet Software, LLC (Stringbet, we, us) to run a step challenge on Stride League. They govern the organizer console at organizer.strideleague.com, the registration page Stringbet publishes for your challenge, and the challenge itself as it appears in the Stride League apps and web interface. Together with the written quote you accept, they are the whole agreement between you and Stringbet for that challenge. Participants are bound by the Terms of Use and the Privacy Policy, not by these terms.
Stringbet sets up your challenge, provides the participant apps for iPhone and Android and the web interface, hosts the service, computes and publishes standings, delivers announcements and notifications, and gives you the organizer console: participants, teams, standings, announcements, sponsor posts, branding, registration settings, invite codes, the report queue, and a view of which phones are syncing. Stringbet creates your account and your challenge; you configure them.
The engagement covers one challenge: setup, the registration period, the challenge dates, and the thirty days after the last day during which messages, the photo wall, announcements and sponsor posts remain open. Results become final at noon in the challenge's time zone on the day after the last day. A further challenge is a further quote.
Stringbet's fee for the challenge is set out in the quote. It is invoiced by Stringbet and payable as the invoice states, exclusive of any applicable tax. Registration opens once the invoice terms are met. Fees for a challenge that has started are not refundable except as the quote states.
You decide whether participants pay to register and how much.
Where participants pay through the registration page, payment is taken by Stripe and settles to your own Stripe account. You are the seller of record. Stripe's processing fees apply under your agreement with Stripe. Stride League keeps five cents of each registration paid through the page, refunds included. Refunds are yours to decide and to issue from your Stripe account; a refunded registration's invite code stops working, and a participant who has already joined stays in the challenge until you remove them. Stringbet never holds your registration money.
Where you collect payment yourself, or charge nothing, Stringbet issues invite codes for you to distribute. A shared code admits anyone who has it; you are responsible for how it is distributed.
Sponsor posts appear in the app labeled as sponsor content. A sponsor post must not reference any participant's steps, health or activity, must not be targeted by activity, and must not promote alcohol, tobacco, cannabis, firearms, gambling, dietary supplements, weight-loss or other health claims, or multi-level marketing. You confirm this on every send. Sponsors receive no data about participants. Stringbet may remove any announcement, sponsor post or branding at its discretion and will tell you when it does.
Participants can post messages and photos, and can report or block one another. Reports go to your console's report queue first; Stringbet holds a copy as backstop. You will name at least one person to review reports and will act on each report within one business day by removing the content, pausing the participant's messaging, or dismissing it. Stringbet may act on any report itself and may suspend any participant's messaging or account under the participant Terms of Use.
Participants' data is collected by Stringbet under the Privacy Policy. The console shows you what the policy says an organizer can see: each participant's name, team, daily step totals and sync state, and what they post. You may use it only to run the challenge. You must not sell it, pass any of it to a sponsor or other third party, or use it for any purpose outside the event. You will keep it confidential and, where you export or copy it, delete it when the event's business is done. Stringbet deletes participants' data on the schedule in the Privacy Policy and deletes a participant on request; you agree to forward any such request you receive. Your own account data (your name, email address and sign-in records) is kept while your account exists.
Stringbet will keep the service available throughout the challenge, keep the apps published in the App Store and Google Play, respond to your requests during business hours, and tell you of any change to the service that affects a running challenge. Stringbet may change scoring rules only at your request or to correct an error, and will tell you either way.
Stride League, its apps, web interface, console and software are and remain Stringbet's. You receive the right to use them for your challenge under these terms. Your name, logo, banner and other material remain yours; you grant Stringbet a license to display them in the service, in the registration page, and in emails and notifications about your challenge for the term. Stringbet may name you as a client unless you tell us not to.
Step counts come from participants' phones, watches and fitness software through Apple Health and Health Connect, and from entries participants type in where you allow it. Stringbet does not warrant that a count is accurate or that every day is recorded. Standings are provisional until the final, and Stringbet's role is to compute them faithfully from the data received.
The service is provided as is. To the fullest extent the law allows, Stringbet disclaims all warranties not stated in these terms, and is not liable for indirect, incidental, consequential, special or punitive damages, or for lost revenue, prizes or data, arising from the service or the challenge. Stringbet's total liability to you for any claim is limited to the fees you paid Stringbet for the challenge in question. You will indemnify Stringbet against claims arising from content you publish through the service, from the rules and prizes of your challenge, and from your use of participant data.
Either party may end the engagement for a material breach that is not cured within ten days of written notice. Stringbet may suspend the service, or any content, at once where the law requires it or where continued operation would breach an app store's rules. If the engagement ends before the challenge does, participants keep access to their own data under the Privacy Policy, and fees already paid are handled as section 3 states.
Changes to these terms appear at this address with an updated date and apply to challenges quoted after that date. A challenge already under way runs under the terms in force when its quote was accepted.
These terms are governed by the laws of the State of Mississippi and the United States. Any dispute that cannot be resolved between the parties will be brought in the state or federal courts located in Oktibbeha County, Mississippi.
